In *Engaging Capital Emotions,* Douglas Berman and Stephanos Bibas argue that emotion is central to understanding and evaluating the death penalty, and that the emotional case for the death penalty for child rape may be even stronger than for adult murder. Both the Berman and Bibas article and the subsequent Supreme Court decision in Kennedy v. Louisiana (striking down the death penalty for child rape) raise difficult questions about how to measure the heinousness of crimes other than murder, and about (...) the role the pain suffered by victims and victims' families should play in this inquiry. In this Reply, I agree with the authors on the importance of confronting emotion's role in capital punishment, for reasons I discuss in Part A. However, I disagree with their claim that the moral outrage evoked by child rape supports making it a capital crime. Part B explores the difficulties of using the existence of moral outrage as a measure of appropriate punishment. Part C argues that the penal system should not merely reflect moral outrage, but channel and educate it. It suggests that the availability of the death penalty may create an anchoring effect, communicating the message that the death penalty is the proper way to express moral outrage and to honor the worth of murder victims. It explores the consequences of this message. Section II focuses on the role of emotion in deciding whether child rape should be a capital crime. Part A considers the problematic role of victim harm in determining whether the death penalty is appropriate. It explores the question, raised in Kennedy v Louisiana, of whether the effect of a capital trial on child rape victims ought to be part of the calculus. Part B argues that there are three particular problems with allowing juries to sentence child rapists to death: the deleterious effect of anger and empathy, the problem of generic prejudice, and the issue of race. In this short paper I will introduce an idea which, I will argue, presents a fundamental additional challenge to the machine consciousness community. The idea takes the questions surrounding phenomenology, qualia and phenomenality one step further into the realm of intersubjectivity but with a twist, and the twist is this: that an agent’s intersubjective experience is deeply felt and necessarily co-affective; it is enkinaesthetic, and only through enkinaesthetic awareness can we establish the affective enfolding which enables first the perturbation, and (...) then the balance and counter-balance, the attunement and co-ordination of whole-body interaction through reciprocal adaptation. My aim in this paper is to go some way towards showing that the maintenance of hard and fast dichotomies, like those between mind and body, and the real and the virtual, is untenable, and that technological advance cannot occur with being cognisant of its reciprocal ethical implications. In their place I will present a softer enactivist ontology through which I examine the nature of our engagement with technology in general and with virtual realities in particular. This softer ontology is (...) one to which I will commit Kant, and from which, I will show, certain critical moral and emotional consequences arise. It is my contention that Kant’s logical subject is necessarily embedded in the world and that Kant, himself, would be content with this view as an expression of his inspired response to the ‘‘scandal to philosophy... that the existence of things outside us... must be accepted merely on faith’’ [Bxl]. In keeping with his arguments for the a priori framing of intuition, the a priori structuring of experience through the spontaneous application of the categories, the synthesis of the experiential manifold, and the necessity of a unity of apperception, I will present an enactivist account of agency in the world, and argue that it is our embodied and embedded kinaesthetic engagement in our world which makes possible the syntheses of apprehension, reproduction and recognition, and which, in turn, make possible the activity of the reproductive or creative imagination. This book is an invitation to academic administrators, at every level, to engage in reflection on the ethical dimensions of their working lives.

Social participation requires certain abilities: communication with other members of society; social understanding which enables planning ahead and dealing with novel circumstances; and a theory of mind which makes it possible to anticipate the mental state of another. In childhood play we learn how to pretend, how to put ourselves in the minds of others, how to imagine what others are thinking and how to attribute false beliefs to them. Without this ability we would be unable to deceive and detect (...) deception in the actions of others, and our ability to interact within our social group would be greatly impaired. In this paper I claim that the capacity for deception is necessary for a theory of mind, and a theory of mind is necessary for complex social interaction. (shrink)

In Equal Citizenship and Public Reason, Watson and Hartley dispute the claim that Rawls’s doctrine of political liberalism must tolerate gender hierarchy because it counts conservative and orthodox religions as reasonable comprehensive doctrines. I argue that their defense in fact contains two arguments, both of which fail. The first, which I call the “Deliberative Equality Argument”, fails because it does not establish conclusively that political liberalism’s demand for equal citizenship forbids social practices of domination, as the authors contend. This paper develops a notion of manipulative gaslighting, which is designed to capture something not captured by epistemic gaslighting, namely the intent to undermine women by denying their testimony about harms done to them by men. Manipulative gaslighting, I propose, consists in getting someone to doubt her testimony by challenging its credibility using two tactics: “sidestepping” and “displacing”. I explain how manipulative gaslighting is distinct from reasonable disagreement, with which it is sometimes confused. I also argue for three further claims: (...) that manipulative gaslighting is a method of enacting misogyny, that it is often a collective phenomenon, and, as collective, qualifies as a mode of psychological oppression. This paper argues that, with modification, Rawls's social contract theory can produce principles of distributive justice applying to the severely disabled. It is a response to critics who claim that Rawls's assumption that the parties in the original position represent fully cooperating citizens excludes the disabled from the social contract. I propose that this idealizing assumption should be dropped at the constitutional stage of the contract where the parties decide on a social minimum. Knowing that they might not be fully (...) capable of social cooperation, the parties will choose a social minimum that is as high and comprehensive as is compatible with the difference principle. This will ensure that the disabled have an adequate income. (shrink)

Kant claims that persons have a perfect duty to respect themselves. I argue, first, that Kant’s argument for the duty of self-respect commits him to an implausible view of the nature of self-respect: he must hold that failures of self-respect are either deliberate or matter of self-deception. I argue, second, that this problem cannot be solved by understanding failures of self-respect as failures of rationality because such a view is incompatible with human psychology. Surely it is not irrational for people, (...) especially members of oppressed groups, to view themselves as having diminished moral worth. (shrink)

So-called “ugly laws” were mostly municipal statutes in the United States that outlawed the appearance in public of people who were, in the words of one of these laws, “diseased, maimed, mutilated, or in any way deformed, so as to be an unsightly or disgusting object” (Chicago City Code 1881). Although the moniker “ugly laws” was coined to refer collectively to such ordinances only in 1975 (Burgdorf and Burgdorf 1975), it has become the primary way to refer to such laws, (...) which targeted the overlapping categories of the poor, the homeless, vagrants, and those with visible disabilities. Enacted and actively enforced between the American Civil War (1867) and World War I (1918), such laws and their enforcement can tell us much about the very sorts of people who were also, a generation later, subject to explicitly eugenic laws, such as sterilization legislation. And like eugenic laws and policies, such laws continue to affect the lives of people with disabilities to this day (Schweik 2011). (shrink)

Hypothetical contracts have been said to be not worth the paper they are not written on. This paper defends hypothetical consent theories of justice, such as Rawls's, against the view that they lack justificatory power. I argue that while hypothetical consent cannot generate political obligation, it can generate political legitimacy.

Because contractarians see justice as mutual advantage, they hold that justice can be rationally grounded only when each can expect to gain from it. John Rawls seems to avoid this feature of contractarianism by fashioning the parties to the contract as Kantian agents whose personhood grounds their claims to justice. But Rawls also endorses the Humean idea that justice applies only if people are equal in ability. It would seem to follow from this idea that dependent persons (such as the (...) disabled) lack claims of justice. It appears, then, that the Kantian and Humean themes in Rawls conflict. I present a reading of Rawls that resolves this tension between the Kantian and Humean themes. The first theme, I argue, allows Rawls to maintain that persons as such are owed justice regardless of their ability to engage in social cooperation. The second theme, I argue, allows him to retain Hume's connection between justice and reciprocity, but confines the reciprocity condition to relations among nondependents. I conclude that Rawls's approach permits him to rebut recent criticisms leveled by disability theorists and others who claim that his theory excludes dependents. (shrink)

I argue that partialist critics of deontological theories make a mistake similar to one made by critics of utilitarianism: they fail to distinguish between a theory’s decision procedure and its standard of rightness. That is, they take these deontological theories to be offering a method for moral deliberation when they are in fact offering justificatory arguments for moral principles. And while deontologists, like utilitarians do incorporate impartiality into their justifications for basic principles, many do not require that agents utilize impartial (...) methods of moral deliberation. It follows that insofar as partialists reject impartiality in deliberation, their criticisms may miss their mark. If however, partialists are opposed to justifications for basic principles that rely upon impartiality, they are committed, I argue, to drastic revisions in moral theory that have worrisome implications. There appears to be a tension between two commitments in liberalism. The first is that citizens, as rational agents possessing dignity, are owed a justification for principles of justice. The second is that members of society who do not meet the requirements of rational agency are owed justice. These notions conflict because the first commitment is often expressed through the device of the social contract, which seems to confine the scope of justice to rational agents. So, contractarianism seems to ignore (...) the justice claims of the severely cognitively impaired. To solve this problem, Martha Nussbaum proposes the capabilities approach. The justifiability condition, on this approach, is met by the idea of overlapping consensus. This essay argues that overlapping consensus cannot meet liberalism’s justifiability condition, nor is it more inclusive of the cognitively impaired. Therefore, we have reason to retain the contract device and look for another way to ensure that liberalism respects the justice claims of all. (shrink)

Luck egalitarianism has been criticized for condoning some cases of oppression and condemning others for the wrong reason—namely, that the victims were not responsible for their oppression. Oppression is unjust, however, the criticism says, regardless of whether victims are responsible for it, simply because it is contrary to the equal moral standing of persons. I argue that four luck egalitarian responses to this critique are inadequate. Two address only the first part of the objection and do so in a way (...) that risks making luck egalitarianism inconsistent. A third severely dilutes the luck egalitarian doctrine. A fourth manages to denounce some instances of oppression for the right reason, but at the same time permits other instances of oppression and condemns yet others for the wrong reason. (shrink)

Brecht’s Life of Galileo provides elements for elaborating what I call “a theory of the encounter of practices”. The concept of the encounter pushes back against teleological theories that predestine modern science to operate as an instrument of domination. I argue that Life of Galileo stages the missed encounters in modernity between science, politics, and art at the same time as it foregrounds the emancipatory power of science. I trace the encounter of practices from the play’s opening scenes – highlighting (...) what I call Galileo’s “double life”. Then, I turn to the most important scene of the play, Scene 10, in which political and artistic practices repurpose Galileo’s novel inventions for their emancipatory desires. In the virtual potentialities of this encounter, that is, despite the missed encounter between Galileo and “the people”, Brecht’s Life of Galileo continues to be fruitful for theorizing the emancipatory power of science. In addition to having an institutional site or scope, a theory of distributive justice might also have an institutional ‘reach’ or currency. It has the first when it applies to only social phenomena. It has the second when it distributes only socially produced goods. One objection to luck egalitarianism is that it has absurd implications. In response, Tan has defended a luck egalitarian account that has a strictly institutional reach. I argue, first, that Tan’s view contains two fatal ambiguities and, (...) second, that, to be sound, it requires an institutional currency. This second argument implies that virtually all extant luck egalitarian currencies are incompatible with his approach. I argue, third, that the alleged absurd implications often have little to do with the extent of luck egalitarianism’s reach. (shrink)

This paper argues that luck egalitarianism, especially in the guise of equality of opportunity for welfare, is in tension with the ideal of fair equality of opportunity in three ways. First, equal opportunity for welfare is compatible with a caste system in employment that is inconsistent with open competition for positions. Second, luck egalitarianism does not support hiring on the basis of qualifications. Third, amending luck egalitarianism to repair this problem requires abandoning fair access to qualifications. Insofar as luck egalitarianism (...) cannot support fair equality of opportunity, it cannot do justice to the claims of the disabled. Indeed, in the absence of fair equality of opportunity, disabled people are likely to be marginalized. (shrink)

Ethicists of care have objected to traditional moral philosophy's reliance upon abstract universal principles. They claim that the use of abstraction renders traditional theories incapable of capturing morally relevant, particular features of situations. I argue that this objection sometimes conflates two different levels of moral thinking: the level of justification and the level of deliberation. Specifically, I claim that abstraction or attention to context at the level of justification does not entail, as some critics seem to think, a commitment to (...) abstraction or attention to context at the level of deliberation. It follows that critics who reject a theory's use of abstraction at the level of justification have not shown that the theory recommends abstraction at the level of deliberation and that it, therefore, compels the deliberating agent to overlook morally salient details. In what follows, I will provide some elements for constructing Mariátegui’s plural spatiotemporal conception of history. I will do so by focusing on the two books he published in his lifetime: The contemporary scene and Seven Interpretive Essays on Peruvian Reality. In a footnote in the Seven Essays, the reader encounters a concept that opens up the problem of plural temporality in Latin American Marxism: relativismo histórico (historical relativism). This will be the keystone concept upon which certain fragments of Mariátegui’s (...) writings will be put together to construct the concept of plural temporality. This involves taking a detour through what Mariátegui understood by relativismo (relativism). In that detour, we find that Mariátegui’s use of relativismo consists in translating and assimilating the insights of one of the pillars of contemporary physics: Einstein’s theory of relativity. For Mariátegui, the relativistic theory of spacetime undermined the old “absolutes” of the positivist unilinear philosophy of history. I then argue that Mariátegui, through his friend and comrade Hugo Pesce, assimilates and translates the “revolutionary” theory of spacetime as a weapon against the unilinear philosophy of history and as a resource to construct a concept of plural spatiotemporal concept of history. Re-situating Mariátegui’s work along this axis puts some pressure on certain Bergsonian and Sorelian readings that overemphasize the importance of Myth and Humanity as a “metaphysical animal” and thereby tend to underemphasize or outright suppress his creative assimilation and translation of the sciences of his time. Catharine MacKinnon argues that pornography is action, rather than speech. She argues further that the speech/action distinction is what delineates the scope of the First Amendment. It follows, she thinks, that pornography does not fall within the scope of the First Amendment. I argue that the legal distinction between speech and action on which MacKinnon relies is unstable and therefore cannot determine which utterances fall within the scope of the First Amendment. Indeed, attempting to sort utterances by means of the (...) speech/action distinction in order to make this determination can lead to a paradox, which I call the “viewpoint paradox”. That an utterance expresses a particular viewpoint is typically sufficient for its qualifying as speech; yet MacKinnon’s argument that pornography is not speech pivots are her claim that it is an act of subordination because it expresses a particular viewpoint about women. Summary Analogue models are actual physical setups used to model something else. They are especially useful when what we wish to investigate is difficult to observe or experiment upon due to size or distance in space or time: for example, if the thing we wish to investigate is too large, too far away, takes place on a time scale that is too long, does not yet exist or has ceased to exist. The range and variety of analogue models is too (...) extensive to attempt a survey. In this article, I describe and discuss several different analogue model experiments, the results of those model experiments, and the basis for constructing them and interpreting their results. Examples of analogue models for surface waves in lakes, for earthquakes and volcanoes in geophysics, and for black holes in general relativity, are described, with a focus on examining the bases for claims that these analogues are appropriate analogues of what they are used to investigate. A table showing three different kinds of bases for reasoning using analogue models is provided. Finally, it is shown how the examples in this article counter three common misconceptions about the use of analogue models in physics. (shrink)

During the past decades, our image ofHomo neanderthalensishas changed dramatically. Initially, Neanderthals were seen as primitive brutes. Increasingly, however, Neanderthals are regarded as basically human. New discoveries and technologies have led to an avalanche of data, and as a result of that it becomes increasingly difficult to pinpoint what the difference between modern humans and Neanderthals really is. And yet, the persistent quest for a minimal difference which separates them from us is still noticeable in Neanderthal research. Neanderthal discourse is (...) a vantage point from which the logic of ‘us’ versus ‘other’ is critically reconsidered. Studying contemporary academic literature and science autobiographies from an oblique perspective, focusing not on Neanderthals as objects, but on the dynamics of interaction between Neanderthal researchers and their finds, basic convictions at work in this type of research are retrieved. What is at issue is not the actual distinction between modern humans and Neanderthals, but rather the dualistic construction of human and nonhuman. Neanderthal understanding is affected by the desire to safeguard human uniqueness. The overall trend is to identify the human mark or spark, which defines us as favoured ‘winners’. The paradoxes emerging in contemporary Neanderthal discourse are symptomatic of the fact that a dualistic style of thinking is no longer tenable. (shrink)

This work can be regarded as an outline of behavior (human nature) from our greatest descriptive psychologist. In considering these matters we must keep in mind that philosophy is the descriptive psychology of higher order thought (DPHOT), which is another of the obvious facts that are totally overlooked –i.e., I have never seen it clearly stated anywhere. Sadly, Wittgenstein's brilliant exposition of behavior is still understood well by only a handful. -/- Much of the work is aimed at undermining the (...) idea of introspection and private language via clever examples and of course there is a mountain of literature on this topic since but neither W nor anyone else ever makes it clear that the basic argument is trivial—if you don’t have a test that distinguishes between two words they cannot have a role in language and there cannot be any such test for private mental phenomena. In between he is describing how System 1 (the automatic functions of the brain) is described by intransitive uses of verbs such as seeing, remembering (i.e., they are Causally Self Reflexive) and differs from and blends into System 2- the deliberative linguistic system (e.g. p101, 161, 166 etc.). He spends much time showing that disposition words (S2) such as thinking, meaning, judging, interpreting, knowing, understanding, believing, intending, reading, calculating, recognizing, comparing, deciding, counting, imaging etc. are not mental states with a precise duration but that their use depends on their having a clear public outcome-i.e., being transitive verbs (i.e., having Conditions of Satisfaction, which is the phrase Searle invented decades later). A critical review of Wittgenstein's 'On Certainty' which he wrote in 1950-51 and was first published in 1969. Most of the review is spent presenting a modern framework for philosophy (the descriptive psychology of higher order thought) and positioning the work of Wittgenstein and John Searle in this framework and relative to the work of others. It is suggested that this book can be regarded as the foundation stone of psychology and philosophy as it was the first to describe the (...) two systems of thought and shows how our unshakable grasp of the world derives from our innate axiomatic System 1, and how this interacts with System 2. It was a revolution in epistemology since it showed that our actions rest not on judgements but on innate undoubtable axioms leading directly to action. Though this volume is a bit dated, there are few recent popular books dealing specifically with the psychology of murder and it’s a quick overview available for a few dollars, so still well worth the effort. It makes no attempt to be comprehensive and is somewhat superficial in places, with the reader expected to fill in the blanks from his many other books and the vast literature on violence. For an update see e.g., Buss, The Handbook of Evolutionary Psychology 2nd (...) ed. V1 (2016) p 265, 266, 270–282, 388–389, 545–546, 547, 566 and Buss, Evolutionary Psychology 5th ed. (2015) p 26, 96–97,223, 293-4, 300, 309–312, 410 and Shackelford and Hansen, The Evolution of Violence (2014) He has been among the top evolutionary psychologists for several decades and covers a wide range of behavior in his works, but here he concentrates almost entirely on the psychological mechanisms that cause individual people to murder and their possible evolutionary function in the EEA (Environment of Evolutionary Adaptation—i.e., the plains of Africa during the last million years or so). -/- Buss starts by noting that as with other behaviors, ‘alternative’ explanations such as psychopathology, jealousy, social environment, group pressures, drugs and alcohol etc. do not really explain, since the question still remains as to why these produce homicidal impulses, i.e., they are the proximate causes and not the ultimate evolutionary (genetic) ones. As always, it inevitably boils down to inclusive fitness (kin selection), and so to the struggle for access to mates and resources, which is the ultimate explanation for all behavior in all organisms. Sociological data (and common sense) make it clear that younger poorer males are the most likely to kill. He presents his own and others homicide data from industrialized nations, and tribal cultures, conspecific killing in animals, archeology, FBI data and his own research into normal people's homicidal fantasies. Much archeological evidence continues to accumulate of murders, including that of whole groups, or of groups minus young females, in prehistoric times. -/- After surveying Buss’s comments, I present a very brief summary of intentional psychology (the logical structure of rationality), which is covered extensively in my many other articles and books. -/- Those with a lot of time who want a detailed history of homicidal violence from an evolutionary perspective may consult Steven Pinker’s ‘The Better Angels of Our Nature Why Violence Has Declined’(2012), and my review of it easily available on the net and in two of my recent ebooks. Briefly, Pinker notes that murder has decreased steadily and dramatically by a factor of about 30 since our days as foragers. So, even though guns now make it extremely easy for anyone to kill, homicide is much less common. Pinker thinks this is due to various social mechanisms that bring out our ‘better angels’, but I think it’s due mainly to the temporary abundance of resources from the merciless rape of our planet, coupled with increased police presence, with communication and surveillance and legal systems that make it far more likely to be punished. Misrepresentations can be innocuous or even useful, but Kant’s corollary to the formula of universal law appears to involve a pernicious one: “act as if the maxim of your action were to become by your will a universal law of nature”. Humans obviously cannot make their maxims into laws of nature, and it seems preposterous to claim that we are morally required to pretend that we can. Given that Kant was careful to eradicate pernicious misrepresentations from theoretical metaphysics, the imperative (...) to act as if I have this supernatural power has typically been treated as an embarrassment meriting apology. The wording of the corollary may be vindicated, however, by recognizing that “as if” (als ob) is a technical term both in the Critique of Pure Reason and here. It signals a modal shift from the assertoric to the problematic mode of cognition, one that is necessitated by the attempt to incorporate the natural effects of a free will into a universal moral imperative that is philosophically practical. In this paper I sketch how the modal shift makes sense of the corollary as a subjectively necessary, philosophically practical idealization of the extension of human freedom into nature, one that accurately represents a necessary parameter of moral conduct: moral ambition. This book is invaluable as a synopsis of some of the work of one the greatest philosophers of recent times. There is much value in analyzing his responses to the basic confusions of philosophy, and in the generally excellent attempts to connect classical Chinese thought to modern philosophy. Before commenting on the book, I offer comments on Wittgenstein and Searle and the logical structure of rationality. The essays here are mostly already published during the last decade (though some have been updated), along with one unpublished item, and nothing here will come as a surprise to those who have kept up with his work. Like W, he is regarded as the best standup philosopher of his time and his written work is solid as a rock and groundbreaking throughout. (...) However, his failure to take the later W seriously enough leads to some mistakes and confusions. Just a few examples: on p7 he twice notes that our certainty about basic facts is due to the overwhelming weight of reason supporting our claims, but W showed definitively in ‘On Certainty’ that there is no possibility of doubting the true-only axiomatic structure of our System 1 perceptions, memories and thoughts, since it is itself the basis for judgment and cannot itself be judged. In the first sentence on p8 he tells us that certainty is revisable, but this kind of ‘certainty’, which we might call Certainty2, is the result of extending our axiomatic and nonrevisable certainty (Certainty1) via experience and is utterly different as it is propositional (true or false). This is of course a classic example of the “battle against the bewitchment of our intelligence by language” which W demonstrated over and over again. One word- two (or many) distinct uses. -/- His last chapter “The Unity of the Proposition” (previously unpublished) would also benefit greatly from reading W’s “On Certainty” or DMS’s two books on OC (see my reviews) as they make clear the difference between true only sentences describing S1 and true or false propositions describing S2. This strikes me as a far superior approach to S’s taking S1 perceptions as propositional since they only become T or F after one begins thinking about them in S2. However, his point that propositions permit statements of actual or potential truth and falsity, of past and future and fantasy, and thus provide a huge advance over pre or protolinguistic society, is cogent. As he states it “A proposition is anything at all that can determine a condition of satisfaction…and a condition of satisfaction… is that such and such is the case.” Or, one needs to add, that might be or might have been or might be imagined to be the case. -/- Overall, PNC is a good summary of the many substantial advances over Wittgenstein resulting from S’s half century of work, but in my view, W still is unequaled once you grasp what he is saying. Ideally, they should be read together: Searle for the clear coherent prose and generalizations, illustrated with W’s perspicacious examples and brilliant aphorisms. This book is invaluable as a synopsis of some of the work of one the greatest philosophers of recent times. There is much value in analyzing his responses to the basic confusions of philosophy, and in the generally excellent attempts to connect classical Chinese thought to modern philosophy. I take a modern Wittgensteinian view to place it in perspective. This book is a unique attempt to correlate classical Chinese philosophy with that of Searle (S), whom I regard as the best (...) since Wittgenstein (W) and his intellectual heir. The quality of the articles is unusually high for such a collection, which must be due to Mou’s careful selection of papers. Readers will find it instructive to compare this with another recent volume of papers on S’s philosophy – “Thinking About the Real World”— another book on which I have written one of the very few reviews. As with W, everything that S writes is a treasure, but sadly this tome has attracted so little attention that this appears to be the only review, even though it appeared 6 years ago. Its only real deficiency is the failure to print S’s reply to Allinson, since it would correct his numerous substantial mistakes. As noted in my other reviews, such mistakes are of interest since they are the universal defaults of our psychology due to the fact that our language lacks perspicuity, as W first noted in the BBB (Blue and Brown Books) ¾ of a century ago. As the conference was taped, I tried to get the video or a transcript of S’s reply from Mou, S, Allinson and 3 persons at HKUST but nobody would help. The issue of spirituality is inevitably mixed in with the language issues of philosophy in some of the papers here. The many subtleties on the road to dispelling the illusion of the ego and the attaining of enlightenment are another issue entirely, although as in all other arenas, philosophical confusions inevitably arise when talking about religion, as opposed to practicing it. As so often in philosophy, the title not only lays down the battle line but exposes the author’s biases and mistakes, since whether or not we can make sense of the language game ‘Seeing things as they are’ and whether it’s possible to have a ‘philosophical’ ‘theory of perception’ (which can only be about how the language of perception works), as opposed to a scientific one, which is a theory about how the brain works, are exactly the issues. This is (...) classic Searle—superb and probably at least as good as anyone else can produce, but lacking a full understanding of the fundamental insights of the later Wittgenstein and with no grasp of the two systems of thought framework, which could have made it brilliant. As in his previous work, Searle largely avoids scientism but there are frequent lapses and he does not grasp that the issues are always about language games, a failing he shares with nearly everyone. A major flaw of the book is its failure to note Wittgenstein’s role in destroying the mechanical or reductionist or computationalist view of mind. These continue to dominate cognitive science and philosophy, in spite of the fact that they were powerfully countered by W and later by Searle and others. -/- There is much talk of W’s use of terms like “grammar”, “rules” etc. but never a clear mention that they mean our Evolved Psychology or our genetically programmed innate behavior. (...) There are references to Baker and Hacker's works and to Malcolm Budd, but none to many standard W refs such as ter Hark, Johnston, and especially to the searchable Intelex CDROM and online sites of his complete works, nor to Searle, and none to the vast literature of evolutionary psychology. -/- Many sections of the book are reasonably successful in describing W’s work but there is much aimless wandering and many mistakes and confusions. These will hopefully be obvious to those who read the above and my other reviews as I cannot recount more than a few of the hundreds of critical comments I made in my two readings of this book. A major flaw, common to most writing in the behavioral sciences, is the lack of awareness of the S1/S2 two selves or two systems of thought mode of describing personality that W pioneered (though nobody noticed) and a failure to be clear about nature/nuture issues. The fast, automatic perceptions, ‘rules’ and behaviors of S1 are mushed together with the slow conscious dispositional thinking, believing and rule following of S2 and neither are clearly or consistently distinguished from arbitrary cultural behaviors. -/- Like all authors until very recently, they fail to give Wittgenstein’s last work “On Certainty” the prominent position it deserves, and likewise fail to take advantage of the powerful dual systems of thought framework. Nor have they adopted the useful extensions of Wittgenstein’s work made by John Searle. So, I first lay out a framework for intentionality (behavior) and then provide some detailed comments. Wittgenstein (W) is for me easily the most brilliant thinker on human behavior and this is his last work and crowning achievement. It belongs to his third and final period, yet it is not only his most basic work (since it shows that all behavior is an extension of innate true-only axioms and that our conscious ratiocination is but icing on unconscious machinations), but as Daniele Moyal-Sharrock has recently noted, is a radical new epistemology and the foundation for all description (...) of animal behavior, revealing how the mind works and indeed must work. The "must" is entailed by the fact that all brains share a common ancestry and common genes, and so there is only one basic way they work, that this necessarily has an axiomatic structure, that all higher animals share the same evolved psychology based on inclusive fitness, and in humans this is extended into a personality based on throat muscle contractions (language) that evolved to manipulate others (with variations that can be regarded as trivial). The tragedy of the commons is a primary contributing factor in ensuring that humanity makes no serious inroads in averting climate change. As a recent Canadian politician pointed out, we could shut down the Canadian economy tomorrow, and it would make no measurable difference in global greenhouse gas emissions. When coordinated effort is required, it would seem that doing the “right thing” alone is irrational: it will harm oneself with no positive consequences as a result. Such is the tragedy. And (...) that is the challenge that we take up here. Though Garrett Hardin suggests that the solution is a governmental process that rules over all contenders, since a world government seems unlikely before the planet hits the tippy point, we suggest an educational initiative instead: one that holds a mirror up to the behaviour of individuals, rather than to the behaviour of individuals in groups. Such an educational initiative would be focused on priming individuals to keep constant track of what they do as individuals as opposed to focusing on the behaviour of humanity in general. Such an educational initiative would focus on tackling the “problem solvers” rather than just “the problem”. (shrink)

This dissertation concerns the methodology Kant employs in the first two sections of the Groundwork of the Metaphysics of Morals (Groundwork I-II) with particular attention to how the execution of the method of analysis in these sections contributes to the establishment of moral metaphysics as a science. My thesis is that Kant had a detailed strategy for the Groundwork, that this strategy and Kant’s reasons for adopting it can be ascertained from the Critique of Pure Reason (first Critique) and his (...) lectures on logic, and that understanding this strategy gains us interpretive insight into Kant’s moral metaphysics. At the most general level of methodology, Kant says there are four steps for the establishment of any science: 1) make distinct the idea of the natural unity of its material 2) determine the special content of the science 3) articulate the systematic unity of the science 4) critique the science to determine its boundaries The first two of these steps are accomplished by the genetically scholastic method of analysis, paradigmatically the method whereby confused and obscure ideas are made clear and distinct, thereby logically perfecting them and transforming them into possible grounds of cognitive insight that are potentially complete and adequate to philosophical purposes. The analysis of Groundwork I is a paradigmatic analysis that makes distinct what is contained in common understanding, i.e. its Inhalt or intension, making distinct the higher partial concepts that together define the concept of morality. The analysis of Groundwork II is an employment more specifically of the method of logical division, which makes distinct what is contained under the concept, i.e. its Umfang, by which the extension or object of morality is determined. Part I introduces Kant’s conception of moral metaphysical science and why he took it to be in need of establishment, explains the general method for establishing science and the scholastic method of analysis by which its first two steps are to be accomplished, then provides an interpretation of Groundwork I as an execution of this method. Part II details Kant’s determination of the special content of moral science in Groundwork II in relation to the central problem for moral metaphysics – how synthetic a priori practical cognition is possible. I provide a critical survey of some of the major findings of Wittgenstein and Searle on the logical structure of intentionality(mind, language, behavior), taking as my starting point Wittgenstein’s fundamental discovery –that all truly ‘philosophical’ problems are the same—confusions about how to use language in a particular context, and so all solutions are the same—looking at how language can be used in the context at issue so that its truth conditions (Conditions of Satisfaction or COS) are clear. The basic problem (...) is that one can say anything but one cannot mean (state clear COS for) any arbitrary utterance and meaning is only possible in a very specific context. Ce n’est pas un livre parfait, mais il est unique, et si vous écrémez les 400 premières pages ou plus, les 300 dernières (sur quelque 700) sont une assez bonne tentative d’appliquer ce qui est connu sur le comportement aux changements sociaux de la violence et des manières au fil du temps. Le sujet fondamental est le suivant : comment notre génétique contrôle-t-elle et limite-t-elle le changement social ? Étonnamment, il ne parvient pas à décrire la nature de la sélection (...) des parents (fitness inclusif) qui explique une grande partie de la vie sociale animale et humaine. Il n’a pas non plus (comme presque tout le monde) un cadre clair pour décrire la structure logique de la rationalité (LSR—terme préféré de John Searle) que je préfère appeler la psychologie descriptive de la pensée de haut ordre (DPHOT). Il aurait dû dire quelque chose sur les nombreuses autres façons d’abuser et d’exploiter les gens et la planète, car ceux-ci sont maintenant beaucoup plus graves que de rendre d’autres formes de violence presque hors de propos. Environ 200.000 personnes de plus par jour (un autre Las Vegas tous les 10 jours, un autre Los Angeles chaque mois), les 6 tonnes ou plus de la base va dans la mer / personne / année - environ 1% du total du monde disparaissant chaque année, etc. signifie que si un miracle se produit la biosphère et la civilisation va largement s’effondrer au cours des deux prochains siècles, et il y aura la famine, la misère et la violence de tous les types. Les manières, les opinions et les tendances des gens à commettre des actes de violence ne sont d’aucune pertinence à moins qu’ils ne puissent faire quelque chose pour éviter cette catastrophe, et je ne vois pas comment cela va se produire. Il n’y a pas de place pour les arguments, et aucun point non plus (oui je suis un fataliste), donc je vais juste faire quelques commentaires comme s’ils étaient des faits. N’imaginez pas que j’ai un intérêt personnel dans la promotion d’un groupe au détriment des autres. J’ai 78, n’ont pas de descendants et pas de proches parents et ne s’identifient à aucun groupe politique, national ou religieux et considèrent ceux que j’appartiens par défaut aussi répugnant que tout le reste. Les parents sont les pires ennemis de la vie sur Terre et, compte tenu de la vue générale des choses, les femmes sont aussi violentes que les hommes quand on considère le fait que la violence des femmes (comme la plupart de celle faite par les hommes) se fait en grande partie au ralenti, à une distance dans le temps et l’espace et la plupart du temps effectuée par procuration -par leurs descendants et par les hommes. On peut considérer que les gens et leur progéniture méritent richement toute la misère vient leur chemin et (à de rares exceptions près) les riches et les célèbres sont les pires délinquants. Meryl Streep ou Bill Gates ou J.K Rowling et chacun de leurs enfants peuvent détruire 50 tonnes de terre d’o re plus chaque année pendant des générations dans l’avenir, tandis qu’un fermier indien et son peut détruire 1 tonne. Si quelqu’un nie que c’est très bien, et à leurs descendants, je dis "Bienvenue à l’enfer sur Terre"(WTHOE). Aujourd’hui, l’accent est toujours mis sur les droits de l’homme, mais il est clair que si la civilisation doit avoir une chance, les responsabilités humaines doivent remplacer les droits de l’homme. Personne n’obtient des droits sans être un citoyen responsable et la première chose que cela signifie est la destruction de l’environnement minimal. La responsabilité la plus fondamentale n’est pas les enfants à moins que votre société vous demande de les produire. Une société ou un monde qui permet aux gens de se reproduire au hasard sera toujours exploité par des gènes égoïstes jusqu’à ce qu’il s’effondre (ou atteint un point où la vie est si horrible qu’il ne vaut pas la peine de vivre). Horwich donne une belle analyse de Wittgenstein (W) et est un érudit W de premier plan, mais à mon avis, ils sont tous en deçà d’une pleine appréciation, comme je l’explique longuement dans cet examen et beaucoup d’autres. Si l’on ne comprend pas W (et de préférence Searle aussi) alors je ne vois pas comment on pourrait avoir plus qu’une compréhension superficielle de la philosophie et de la pensée de l’ordre supérieur et donc de tout comportement complexe (psychologie, sociologie, anthropologie, (...) histoire, littérature, société). En un mot, W a démontré que lorsque vous avez montré comment une phrase est utilisée dans le contexte d’intérêt, il n’y a rien de plus à dire. Je vais commencer par quelques citations notables, puis donner ce que je pense sont les considérations minimales nécessaires pour comprendre Wittgenstein, la philosophie et le comportement humain. Tout d’abord, on pourrait noter que mettre "meta" en face de n’importe quel mot devrait être suspect. W a fait remarquer par exemple, que la métamathématique est mathématiques comme les autres. L’idée que nous pouvons sortir de la philosophie (c’est-à-dire la psychologie descriptive de la pensée de haut ordre) est elle-même une profonde confusion. Une autre irritation ici (et tout au long de l’écriture académique pour les 4 dernières décennies) est le sexisme linguistique inverse constant de «elle» et «la sienne» et «elle» ou «il / elle», etc, où «ils» et «leur» et «eux» ferait bien. De même, l’utilisation du mot Français «répertoire» où le «répertoire» anglais se portera plutôt bien. La lacune majeure est l’échec complet (bien que très commun) d’employer ce que je considère comme la vue extrêmement puissante et intuitive de deux systèmes de HOT et Searle cadre que j’ai décrit ci-dessus. C’est particulièrement poignant dans le chapitre sur le sens p111 et seq. (en particulier dans les notes de bas de page 2-7), où nous nageons dans l’eau très boueuse sans le cadre de l’automatisé vrai seul S1, propositionnelle dispositionnelle S2, COS etc. On peut également avoir une meilleure vue de l’intérieur et de l’extérieur en lisant par exemple, Johnston ou Budd (voir mes commentaires). Horwich fait cependant beaucoup de commentaires incisifs. J’ai particulièrement aimé son résumé de l’importation de la position anti-théorique de W sur p65. Il doit mettre davantage l’accent sur 'On Certainty', récemment l’objet de beaucoup d’efforts de Daniele Moyal- Sharrock, Coliva et d’autres et résumé dans mes récents articles. Horwich est de premier ordre et son travail vaut bien l’effort. On espère qu’il (et tout le monde) étudiera Searle et une certaine psychologie moderne ainsi que Hutto, Read, Hutchinson, Stern, Moyal-Sharrock, Stroll, Hacker et Baker, etc. pour atteindre une large vision moderne du comportement. Il donne l’un des plus beaux résumés de l’endroit où une compréhension de Wittgenstein nous laisse que j’ai jamais vu. « Il ne doit y avoir aucune tentative d’expliquer notre activité linguistique/conceptuelle (PI 126) comme dans la réduction de l’arithmétique à la logique de Frege ; aucune tentative de lui donner des fondations épistémologiques (PI 124) comme dans les comptes basés sur le sens d’une connaissance a priori; aucune tentative de caractériser des formes idéalisées de celui-ci (PI 130) comme dans le sens logique; aucune tentative de réforme (PI 124, 132) comme dans la théorie de l’erreur de Mackie ou l’intuitionnisme de Dummett; aucune tentative de rationaliser (PI 133) comme dans le récit de Quine de l’existence; aucune tentative pour le rendre plus cohérent (PI 132) comme dans la réponse de Tarski aux paradoxes menteurs; et aucune tentative pour le rendre plus complet (PI 133) comme dans le règlement des questions d’identité personnelle pour des scénarios hypothétiques bizarres de « téléportation ». Enfin, permettez-moi de suggérer qu’avec la perspective que j’ai encouragée ici, W est au centre de la philosophie et de la psychologie contemporaines et n’est pas obscure, difficile ou non pertinente, mais scintillante, profonde et limpide et que de lui manquer est de manquer l’une des plus grandes aventures intellectuelles possibles. Overall Stern does a fine analysis of Wittgenstein (W) and is one of the top W scholars, but in my view, they all fall short of a full appreciation, as I explain at length in this review and many others. If one does not understand W (and preferably Searle also), then I don't see how one could have more than a superficial understanding of philosophy and of higher order thought and thus of all complex behavior (psychology, sociology, anthropology, history, literature, (...) society). In a nutshell, W demonstrated that when you have shown how a sentence is used in the context of interest, there is nothing more to say. I will start with a few notable quotes and then give what I think are the minimum considerations necessary to understand Wittgenstein, philosophy and human behavior. As Stern is aware, throughout W’s works, understanding is bedeviled by possible alternative and consequently often infelicitous translations from often unedited and handwritten German notes, with “Satz” being frequently incorrectly rendered as “proposition” (which is a testable or falsifiable statement) when referring to our non-falsifiable psychological axioms, as opposed to the correct “sentence”, which CAN be applied to our axiomatic true-only statements such as “these are my hands” or “Tyrannosaurs were large carnivorous dinosaurs that lived about 50 million years ago”. -/- Finally, let me suggest that with the perspective I have encouraged here, W is at the center of contemporary philosophy and psychology and is not obscure, difficult or irrelevant, but scintillating, profound and crystal clear and that to miss him is to miss one of the greatest intellectual adventures possible. This is Wittgenstein´s least interesting book, being only random notes dealing with art, music, religion and other areas of culture, taken from his notebooks over the course of his life. But W is never dull and it's a measure of the awe in which he is held that this book was even published. I can´t imagine publishing such a book by anyone else; certainly no philosopher. Dernier Sermon de l’Église du naturalisme fondamentaliste par le pasteur Hofstadter. Avant de commenter le livre, je vous propose des commentaires sur Wittgenstein et Searle et la structure logique de la rationalité. Les essais ici sont pour la plupart déjà publiés au cours de la dernière décennie (bien que certains ont été mis à jour), avec un élément non publié, et rien ici ne viendra comme une surprise pour ceux qui ont suivi son travail. Comme W, il est considéré comme le meilleur philosophe standup de son temps et son travail écrit (...) est solide comme un rocher et révolutionnaire tout au long. Cependant, son incapacité à prendre le W plus tard assez au sérieux conduit à quelques erreurs et confusions. Juste quelques exemples: sur p7, il note deux fois que notre certitude sur les faits de base est due à l’importance écrasante de la raison à l’appui de nos revendications, mais W a montré définitivement dans «Sur la certitude» qu’il n’y a aucune possibilité de douter de la véritable seule structure axiomatique de notre système 1 perceptions, souvenirs et pensées, car il est lui-même la base du jugement et ne peut pas lui-même être jugé. Dans la première phrase sur p8, il nous dit que la certitude est révisable, mais ce genre de «certitude», que nous pourrions appeler Certainty2, est le résultat de l’extension de notre certitude axiomatique et non révisible (Certitude1) par l’expérience et est tout à fait différent car il est proposé (vrai ou faux). C’est bien sûr un exemple classique de la « bataille contre l’envoûtement de notre intelligence par la langue » dont W a démontré maintes et maintes fois. Un mot- deux (ou plusieurs) utilisations distinctes. Son dernier chapitre "L’unité de la proposition" (précédemment inédit) bénéficierait également grandement de la lecture de W "On Certainty" ou les deux livres de DMS sur OC (voir mes commentaires) car ils font clairement la différence entre les phrases vraies seulement décrivant S1 et les propositions vraies ou fausses décrivant S2. Cela me semble comme une approche bien supérieure à S de prendre S1 perceptions comme propositionnelle car ils ne deviennent T ou F après que l’on commence à penser à eux dans S2. Cependant, son point que les propositions permettent des déclarations de vérité réelle ou potentielle et de fausseté, du passé et du futur et de la fantaisie, et donc fournir une énorme avancée sur la société pré ou protolinguistique, est convaincante. Comme il l’affirme : « Une proposition est tout ce qui peut déterminer une condition de satisfaction... et une condition de satisfaction... est que tel ou tel est le cas. Ou, il faut ajouter, qui pourrait être ou aurait pu être ou pourrait être imaginé pour être le cas. Dans l’ensemble, PNC est un bon résumé des nombreuses avancées substantielles sur Wittgenstein résultant du demi-siècle de travail de S, mais à mon avis, W est toujours inégalé une fois que vous saisissez ce qu’il dit. Idéalement, ils devraient être lus ensemble: Searle pour la prose et les généralisations clairement cohérentes, illustrés par les exemples perspicaces de W et les aphorismes brillants. Si j’étais beaucoup plus jeune, j’écrirais un livre faisant exactement cela. A superb effort, but in my view Wittgenstein (i.e., philosophy or the descriptive psychology of higher order thought) is not completely understood by anyone, so we can hardly expect Budd, writing in the mid 80’s, without the modern dual systems of thought view, and no comprehensive logical structure of rationality, to have grasped him completely. Like everyone, he does not get that W’s use of the word ‘grammar’ refers to our innate Evolutionary Psychology and the general framework of Wittgenstein’s and (...) Searle’s work since laid out (e.g., in my recent articles) was unavailable to him. Nevertheless, he does a good job and nicely complements the work by Johnston (Wittgenstein: Rethinking the Inner) which I have also reviewed. Budd’s summary is a fitting end to the book (p165). “The repudiation of the model of ‘object and designation’ for everyday psychological words—the denial that the picture of the inner process provides a correct representation of the grammar of such words, is not the only reason for Wittgenstein’s hostility to the use of introspection in the philosophy of psychology. Before commenting in detail on making the Social World (MSW) I will first offer some comments on philosophy (descriptive psychology) and its relationship to contemporary psychological research as exemplified in the works of Searle (S) and Wittgenstein (W), since I feel that this is the best way to place Searle or any commentator on behavior, in proper perspective. It will help greatly to see my reviews of PNC, TLP, PI, OC, TARW and other books by these two geniuses of descriptive (...) psychology. -/- S makes no reference to W’s prescient statement of mind as mechanism in TLP, and his destruction of it in his later work. Since W, S has become the principal deconstructor of these mechanical views of behavior, and the most important descriptive psychologist (philosopher), but does not realize how completely W anticipated him nor, by and large, do others (but see the many papers and books of Proudfoot and Copeland on W, Turing and AI). S’s work is vastly easier to follow than W’s, and though there is some jargon, it is mostly spectacularly clear if you approach it from the right direction. See my reviews of W S and other books for more details. -/- Overall, MSW is a good summary of the many substantial advances over Wittgenstein resulting from S’s half century of work, but in my view, W still is unequaled for basic psychology once you grasp what he is saying (see my reviews). Ideally, they should be read together: Searle for the clear coherent prose and generalizations on the operation of S2/S3, illustrated with W’s perspicacious examples of the operation of S1/S2, and his brilliant aphorisms. Dans 'Godel’s Way', trois éminents scientifiques discutent de questions telles que l’indécidabilité, l’incomplétude, le hasard, la calculabilité et la paraconsistence. J’aborde ces questions du point de vue de Wittgensteinian selon lesquelles il y a deux questions fondamentales qui ont des solutions complètement différentes. Il y a les questions scientifiques ou empiriques, qui sont des faits sur le monde qui doivent être étudiés de manière observationnelle et philosophique quant à la façon dont le langage peut être utilisé intelligiblement (qui incluent certaines (...) questions en mathématiques et en logique), qui doivent être décidés en regardant un comment nous utilisons réellement des mots dans des contextes particuliers. Lorsque nous obtenons clair sur le jeu de langue que nous jouons, ces sujets sont considérés comme des questions scientifiques et mathématiques ordinaires comme les autres. Les idées de Wittgenstein ont rarement été égalées et jamais dépassées et sont aussi pertinentes aujourd’hui qu’elles l’étaient il y a 80 ans lorsqu’il a dicté les Livres Bleus et Brown. Malgré ses défauts, vraiment une série de notes plutôt qu’un livre fini, c’est une source unique du travail de ces trois savants célèbres qui travaillent aux confins de la physique, des mathématiques et de la philosophie depuis plus d’un demi-siècle. Many academic works as well as many works of art are such that if they had never been produced, no one would be worse off. Yet it is hard to resist the judgment that some such works are good nonetheless. We are rightly grateful that these works were created; we rightly admire them, appreciate them, and take pains to preserve them. And the authors and artists who produced them have reason to be proud. This should lead us to question the (...) view that in order for a thing to be good, in a sense which implies that the thing merits our attention and positive concern, it needs to be good for someone or something whose welfare is enhanced by it. Il ya quelques années, j’ai atteint le point où je peux généralement dire à partir du titre d’un livre, ou du moins à partir des titres chapitre, quels types d’erreurs philosophiques seront faites et à quelle fréquence. Dans le cas des travaux théoriquement scientifiques, ceux-ci peuvent être largement limités à certains chapitres qui cire philosophique ou essayer de tirer des conclusions générales sur le sens ou la signification à long terme de l’œuvre. Normalement, cependant, les questions scientifiques de fait sont (...) généreusement entrecoupées de charabia philosophique quant à ce que ces faits signifient. Les distinctions claires que Wittgenstein a décrites il y a environ 80 ans entre les questions scientifiques et leurs descriptions par divers jeux linguistiques sont rarement prises en considération, et on est donc tour à tour séduit par la science et consterné par son analyse incohérente. Il en est de même pour ce volume. Si l’on veut créer un esprit plus ou moins comme le nôtre, il faut avoir une structure logique de rationalité et une compréhension des deux systèmes de pensée (théorie du double processus). Si l’on veut philosopher à ce sujet, il faut comprendre la distinction entre les questions scientifiques de fait et la question philosophique de la façon dont le langage fonctionne dans le contexte en cause, et de la façon d’éviter les pièges du réductionnisme et du scientisme, mais Kurzweil, comme la plupart des étudiants de comportement, est largement désemparé. Il est enchanté par les modèles, les théories et les concepts, et l’envie d’expliquer, tandis que Wittgenstein nous a montré que nous n’avons qu’à décrire, et que les théories, les concepts, etc., ne sont que des moyens d’utiliser le langage (jeux linguistiques) qui n’ont de valeur que dans la mesure où ils ont un test clair (les véridiques clairs, ou comme John Searle (le critique le plus célèbre de l’IA) aime à dire, claire conditions de satisfaction (COS)).
